Association May Seek Supreme Court Review
WASHINGTON (December 20, 2012) – The American Chemistry Council (ACC) today issued the following statement regarding the U.S. Court of Appeals for the D.C. Circuit's denial to rehear the case against the Environmental Protection Agency's (EPA) regulation of greenhouse gases:
“While it is unfortunate that the court denied our petition for rehearing en banc, we are encouraged that two of the court’s judges concluded that our legal arguments have merit. ACC continues to believe that the Prevention of Significant Deterioration (PSD) permitting program is not the appropriate way to address greenhouse gas emissions from industrial facilities. For that reason, we will carefully consider seeking Supreme Court review.”
